POSITION SUMMARY

The Calaveras County Counsel’s Office is seeking a Deputy County Counsel I/II. The incumbent will primarily provide legal counsel to the Calaveras Health & Human Services Agency, specifically Child Welfare Services (CWS) and representing the agency in all phases of Welfare and Institutions Code §300 proceedings, from detention through adoptions and including appeals.  The position involves extensive trial work as well as advising social workers, reviewing petitions, court filings, drafting of findings, orders and legal opinions. This position will also include, advising clerical staff on legal issues, preparing and presenting training to CWS staff on legal requirements and issues, including updates to relevant law which affect their role, and preparing social workers to testify in court.

 

Interviews will be held the week of August 7th and has an anticipated start date of September 5, 2017. The incumbent will start as an extra-hire during a two week training phase and will assume the permanent position immediately thereafter.

 

The incumbent will, under direction of County Counsel, perform professional legal work related to civil law; prepare assigned cases and appear in court; provide legal counsel to the County and its departments, boards and commissions; and does related work as required.

 

DISTINGUISHING CHARACTERISTICS:

Deputy County Counsel I

This is the entry level position in the Deputy County Counsel series.  Incumbents are under close supervision and are expected to learn and perform the less difficult and non-controversial assignments in the County Counsel’s office.

 

Deputy County Counsel II

This is the journey level position in the Deputy County Counsel series.  Incumbents are typically assigned a wide range of civil litigation including court and administrative trials.  Incumbents are expected to complete legal assignments with minimal assistance.



EXAMPLE OF DUTIES

  • Confers with and advises the Board of Supervisors, officers and employees of County Departments and representatives of special districts on legal questions pertaining to their duties and responsibilities.
  • Attends meetings of boards and commissions as requested to give legal counsel and advice.
  • Drafts ordinances, resolutions and other legal measures.
  • Prepares pleadings and other papers in connection with suits, trials, hearings and other civil legal proceedings.
  • Makes tentative decisions concerning advisability to prosecute, compromise, or dismiss civil litigation.
  • Defends the County, County agencies, and County employees in actions brought against them, including preparation and trial of cases before courts and administrative agencies.
  • Participates in the settlement of claims for or against the County; performs a variety of legal research.
  • Dictates correspondence and reports.



MINIMUM QUALIFICATIONS

Knowledge of:

California Code dealing with the authority and responsibility of public entities.

Deputy County Counsel I

Basic principles and practices of civil, constitutional and administrative law; basic practices, principles, and methods of legal research.

 

Deputy County Counsel II (in addition to above)

Judicial procedures and processes; principles and practices of pleading; statutes and codes applicable to civil procedures; California law relating to local government.

 

Skill to:

Perform legal research; analyze and apply legal principles, facts, evidence, and precedents to complex legal problems; present law, facts, evidence and arguments, clearly and logically in witting and oral form; effectively represent the Board of Supervisors and County; deal effectively and tactfully with the public; exercise sound independent judgment within general policy guidelines; establish and maintain effective working relationships with those contacted in the course of work.

 

Education, Training and Experience:

Deputy County Counsel I

Equivalent to graduation from an accredited law school.

 

Deputy County Counsel II (in addition to above)

Two years of professional legal experience at a level equivalent to the Deputy County Counsel I.

 

Licenses, Certificates, or Registrations:

  • Possession of a valid California driver’s license.
  • Active membership in the State Bar of California.

PHYSICAL DEMANDS AND WORKING CONDITIONS:

Mobility to work in a standard office environment; use standard office equipment and attend off-site meetings; physical ability to sit or otherwise remain stationary at work post for long periods of time; manual dexterity to use standard office equipment and supplies and to manipulate both single sheets of paper and large document holders (binders, manuals, etc.); vision to read handwritten and printed materials and a computer screen; hearing and speech to communicate in person and by telephone.
